Description

We are Rees Dyck Rogala Law Offices, a criminal defence firm founded by Tom Rees, Michael Dyck and Joshua Rogala. Our practice is dedicated exclusively to defending people charged with criminal offences, from our head office in Winnipeg and our office in Steinbach.

Impaired driving defence in Manitoba

We have experience defending impaired driving, driving over .08 and refusal to provide a sample. We challenge breathalyzer results, examine how police carried out the stop and the testing, and raise Charter arguments where your rights were not respected. A roadside fail or refusal in Manitoba brings a three-month suspension right away, so we also help clients understand the licence consequences.

Our team also defends violent crime, domestic assault, drug, theft and youth charges, acts at bail hearings, and takes appeals to the Manitoba Court of Appeal. We accept Legal Aid.

Charged with impaired driving in Winnipeg? Key facts

From Manitoba DUI Lawyers: most impaired driving stops in Manitoba now begin with an Immediate Roadside Prohibition. A “fail” on a roadside screening device, or a refusal, brings a three-month licence suspension, a $700 administrative penalty, vehicle impoundment, a 10-level drop on the Driver Safety Rating scale and a year in the Ignition Interlock Program. A “warn” reading of .05 to .079 brings a suspension of 72 hours to 60 days and a penalty of at least $400. See Manitoba DUI penalties. You can apply to MPI for a review of the suspension, and police can still lay Criminal Code charges, which go to court separately. Penalties are tougher for serious cases: a second conviction for impaired driving causing death or injury within 10 years now brings a lifetime licence suspension.
