Description

We are Sullivan McMullan, a Winnipeg firm led by Myron Sullivan and Kevin McMullan. We focus exclusively on criminal law, and impaired driving is one of the primary areas of our practice.

Impaired driving defence in Winnipeg

We defend impaired driving and refusal charges, and we help clients deal with the immediate consequences that come with them in Manitoba: a roadside suspension, vehicle impoundment and, after a fail or refusal, a year of ignition interlock. We explain how the provincial penalties and the criminal case run side by side, and what you can do about each.

Every defence starts with the details: the reason for the stop, the roadside screening, the breath or blood demand, the timing of the tests and whether your rights were respected. We give you an honest assessment before you decide how to plead.

We also defend domestic assault, drug and violent crime charges and act at bail hearings. We offer flexible appointment times, and payment plans are available.

Charged with impaired driving in Winnipeg? Key facts

From Manitoba DUI Lawyers: most impaired driving stops in Manitoba now begin with an Immediate Roadside Prohibition. A “fail” on a roadside screening device, or a refusal, brings a three-month licence suspension, a $700 administrative penalty, vehicle impoundment, a 10-level drop on the Driver Safety Rating scale and a year in the Ignition Interlock Program. A “warn” reading of .05 to .079 brings a suspension of 72 hours to 60 days and a penalty of at least $400. See Manitoba DUI penalties. You can apply to MPI for a review of the suspension, and police can still lay Criminal Code charges, which go to court separately. Penalties are tougher for serious cases: a second conviction for impaired driving causing death or injury within 10 years now brings a lifetime licence suspension.
