Highway past a Manitoba lake and spruce forest at dusk

If you received an Immediate Roadside Prohibition or an Administrative Licence Suspension in Manitoba, you can apply to MPI’s Registrar for a review. A reviewing officer decides whether the suspension should stand.

Fees and timing

Type of review Fee When it happens
Written review $50 Completed within 10 days of MPI receiving your application and payment
Oral hearing $100 Held within 20 days; limited to 60 minutes

Payment must go in with the application. MPI’s form says you must apply within one year of receiving the suspension, but the suspension starts right away, so apply as early as you can if you want it to make a difference.

What the reviewer looks at

The grounds depend on the type of suspension. For an Immediate Roadside Prohibition, they include:

  • whether you were the driver or in care or control of the vehicle;
  • the breath test results;
  • whether you asked for a second test and whether it was done; and
  • whether you refused or failed to comply with a demand without a reasonable excuse.

For a three-month Administrative Licence Suspension, the questions are whether you were the driver or in care or control, and whether you were at or over the alcohol or drug limits, or refused without reasonable excuse.

What is not a ground

Hardship is not a ground for review. Losing your job or needing to drive is not a reason the reviewer can consider.

Written or oral?

A written review is decided on your documents, so include all your evidence with the application. An oral hearing lets you or your lawyer explain the evidence in person. A Manitoba impaired driving lawyer can help you decide and prepare. See also Manitoba DUI penalties.
