Description

I am Alan Pearse, and my Winnipeg practice is built around one area of law: impaired driving defence. I have practised since 2000, I am the author of A Guide to Breathalyzer Certificates in Canada, and I personally handle my clients’ trials.

Impaired driving defence in Manitoba

Impaired driving law is technical and keeps changing. Each case depends on whether police followed the rules: the reason for the stop, the roadside screening test, the breath or blood demand, the timing of the samples, your right to call a lawyer, and the records behind the breath testing equipment. I focus on those details because that is where these cases are won or lost.

I defend impaired driving, over .08, refusal to provide a breath sample and drug-impaired driving charges, and I help clients with licence suspensions, impaired driving appeals and licence reinstatement. In Manitoba a roadside “fail” or refusal brings an immediate three-month suspension, so I explain how the court case and the MPI consequences fit together.

I offer a free initial consultation and 24/7 availability.

Charged with impaired driving in Winnipeg? Key facts

From Manitoba DUI Lawyers: most impaired driving stops in Manitoba now begin with an Immediate Roadside Prohibition. A “fail” on a roadside screening device, or a refusal, brings a three-month licence suspension, a $700 administrative penalty, vehicle impoundment, a 10-level drop on the Driver Safety Rating scale and a year in the Ignition Interlock Program. A “warn” reading of .05 to .079 brings a suspension of 72 hours to 60 days and a penalty of at least $400. See Manitoba DUI penalties. You can apply to MPI for a review of the suspension, and police can still lay Criminal Code charges, which go to court separately. Penalties are tougher for serious cases: a second conviction for impaired driving causing death or injury within 10 years now brings a lifetime licence suspension.
